Between 8 April and 3 June 2022, the government sought views on the future water fluoridation consultation process.

In response to the feedback received we will lay before Parliament draft regulations which provide that eligibility to respond to future water fluoridation consultations will not be restricted to those individuals who are directly affected and/or bodies with an interest.

The draft regulations will require the Secretary of State for Health and Social care to consider several factors when deciding on a water fluoridation proposal following consultation. In particular, there will be a duty to consider whether additional weight should be given to representations made by individuals directly affected and/or bodies with an interest.

Consultation description

The Health and Care Bill, currently going through parliament sets out some changes to the water fluoridation legislation in England. If it becomes law, the Bill will allow the Secretary of State, instead of local authorities, to establish new water fluoridation schemes, or to vary or terminate existing water fluoridation schemes in England.

In the event that the Bill is passed, there will be a legal duty on the Secretary of State to undertake a formal public consultation before introducing any new water fluoridation schemes or before varying or terminating an existing scheme. Secondary legislation will need to set out the process for consulting and the results from this consultation will inform that secondary legislation.
