This regulatory position statement (RPS) relates to unused waste plastics coded:

• 15 02 03 personal protective equipment
• 16 03 06 off specification batches and unused products

This RPS does not change your legal requirement to comply with an environmental permit or waste exemption when you:

• treat waste comprised of these unused plastics by shredding, granulation, pelletisation, densification and heat treatment
• use waste comprised of these unused plastics in the manufacture of finished goods

If you comply with the requirements in this RPS, the Environment Agency will not normally take enforcement action when you accept waste coded 15 02 03 or 16 03 06 if you:

• do not have those waste codes in your environmental permit for the treatment or use of waste plastics
• operate under a T4 or U9 waste exemption

This enforcement position does not apply to any other legal requirements.
