Changes have been made to the draft revised Covert Human Intelligence Source (CHIS) code of practice following the public consultation. This will be laid before Parliament and we anticipate that the code will come into force later this year.

Consultation description

The CHIS Code has been redrafted to reflect the new provisions relating to the authorisation of criminal conduct by CHIS brought in by the CHIS Act.

The updates are needed to reflect the changes in the 2021 Act, as well as to make a number of minor updates and clarifications intended to ensure that public authorities apply best practice in the use of the powers.

It is intended to guide law enforcement agencies, the UK Intelligence Community (UKIC) and public authorities who exercise such powers. It sets out additional safeguards as to how the powers already in primary legislation should be exercised.
