The Competition and Markets Authority (CMA) has adopted updated rules and guidance for energy code modification appeals to the CMA to replace the prior rules (CC10) and guide (CC11).

This consultation followed from the CMAs consultation on draft rules of procedure and guidance for energy code modification appeals which took place in our first consultation from 23July to 3September 2024.

This second consultation sought the views of interested parties on the CMAs proposed changes to the draft updated rules and guide to take into account changes to the Energy Act 2004 introduced since the July consultation by the commencement of section?201 and Schedule 14 of the Energy Act 2023.

Following the consultations, revisions were made to the new rules and guidance.

A summary of the responses we received to our consultations and our proposed approach for addressing those responses (including the revisions that we have made) is set out in the consultation response document.
