The Competition and Markets Authority (CMA) has adopted updated rules and guidance for energy code modification appeals to replace the prior rules (CC10) and guide (CC11).
The Rules and Guidance have been amended to:
- reflect the updated legislative framework
- incorporate the CMAs experience of conducting appeals
- align them more closely to the CMA70 rules and CMA71 guide in place for energy licence modification appeals issued in 2022
- reflect the use of technology to reduce administrative burdens
They also take into account changes to the Energy Act 2004 introduced since the first consultation by section 201 and Schedule 14 of the Energy Act 2023. These changes were introduced in our second consultation in November 2024.
Following the consultations, revisions were made to the new rules and guidance. A summary of the responses we received to our consultations and our proposed approach for addressing those responses (including the revisions that we have made) is set out in the consultation response document.
