Guidance: Adding and amending transferors and attorneys in DRS applications

Add an attorney

You can still add an attorney for any party. This ensures that both donor and attorney are accounted for correctly in panel 13 of the e-AP1.

  1. Click on Add an attorney.
  2. Add the attorneys name.
  3. Youll be asked to add representation for both the donor and their attorney.

Transferor name discrepancies

It is important that the names on the e-AP1 and any other documents lodged all match.? To support you with this, you will be shown the details currently held on the register.

  1. On the Review transferor details screen, you can view the details of the registered proprietors we currently hold on the register.
  2. Wherever possible, we pull the details of the current registered proprietors from the digital register and present this on screen for you to check the transferor details.?
  3. If you spot a name discrepancy, you can click to amend the names in the application. This amendment will be reflected in the application.
  4. Youll be prompted to provide the evidence for the change later.?

If your transferor is not the registered proprietor

Where theres an unregistered transfer awaiting processing, the registered proprietors on the register may not be the transferors on your TR1 or TP1.?

You can replace transferors pulled from the register if they are incorrect by clicking on Reset all transferor details if they are incorrect.?

Youll then be able to add the transferors names manually.

Add transferors manually

  1. Select the transferor type.?
  2. Add the transferors names.
  3. Select the capacity in which the transferor is acting.?
  4. For unregistered transferors, select person entitled to be registered as proprietor.

Adding another party

As well as attorneys, sometimes you need to enter additional parties who may be involved in a transaction. These parties include:?

  • additional trustee (for example. for the purposes of over-reaching)?
  • trustee in bankruptcy, liquidator, supervisor, administrator?
  • receiver under the Law of Property Act 1986?
  • deputy appointed under the Mental Capacity Act 2005?
  • guardian appointed under the Guardianship (Missing Persons) Act 2017?
  • personal representative (such as an executor) who assents or transfers the land?

Note: a management company need only be added if they are acting as disponor or disponee.?

  1. If DRS has been able to pull the registered proprietors from the register, they will be presented to you as transferors on this screen.?
  2. You can Remove a transferor, for example, if they have died.?
  3. You can Amend their name, for example, if they have changed it through marriage.?
  4. You can also Add an attorney.?
  5. You can Add a transferor.?

Adding transferor representation

  1. On each transferors details you have the option to add an attorney
  2. Youll be asked to add their details, and then confirm who represents all parties named as transferors next.?
  3. Youll be prompted to lodge the appropriate evidence later (see supporting documents).

Supporting documents

  1. Youll be prompted to attach any evidence required, based on the data youve entered.? Guidance on how to do this will be shown on screen.
  2. Suggested documents are displayed relating to the application.?
  3. Actions such as power of attorney and change of name require evidence.?

When you download the draft e-AP1 before submission, youll see that panel 13 has been populated with the data you have entered.
