If made, the proposed HRO would modernise and partially consolidate the statutory harbour powers applying in relation to the Port of Tyne (the Port). The proposed order provides for clarity on the limits of the Port; the establishment of an advisory body or bodies consisting of port stakeholders with which the applicant is required to consult on material matters; modernised powers of management and control of the Port to vest in the applicant including provisions relating to powers of general direction and special direction, navigational safety, conservation, bunkering, and the levying of charges; and powers to vest in the applicant which include the power to develop or dispose of land, and to grant tenancies.

To facilitate the above, article 43 of the proposed order revokes the Acts and Orders set out in Schedule 2 to the proposed order and amends the Acts and Orders set out in articles 40 to 42 of the proposed order.

The statutory 42-day public consultation on the HRO starts on 15 March 2024. As this 42-day consultation will run across 2 public holidays, the MMO is agreeable to consider consultation responses received up to 3 days beyond the 42-day consultation period.
