Final Decision and Variation Order
13 November 2024: The CMA has made its final decision that the coming into force of the Energy Act 2023 represents a change in circumstance, which results in certain parts of the Energy Market Investigation (Electricity Transmission Losses) Order 2016 becoming no longer appropriate as originally drafted.
Following our consultation on a Notice of Intention to Vary, we have now published our Final Decision and Notice of Variation. We have also published our Variation Order.

Consultation on provisional decision
23 July 2024: The CMA has provisionally found that the coming into force of the Energy Act 2023 represents a change in circumstance which results in certain parts of the Energy Market Investigation (Electricity Transmission Losses) Order 2016 becoming no longer appropriate as currently drafted. We have provisionally found that those parts should be amended by means of a variation order. Our consultation document incorporates a formal Notice of Intention to Vary the Order.
Were now consulting on:
- the CMAs provisional decision on change of circumstances
- the CMAs Notice of Intention to Vary the Order
- the substance of the proposed changes to the Order
The parts of the Order which are not covered by the proposed variation order remain outside the scope of this consultation.

23 July 2024: The CMA has decided to carry out a narrow-scope review of the Energy Market Investigation (Energy Transmission Losses) Order 2016 to reflect certain changes introduced by the Energy Act 2023.
